Abstract

The freedom of thought, conscience and religion represents a fundamental Human Right guaranteed by the European Convention on Human Rights and other legal and political international documents.

In connection with the above mentioned fundamental right, the protection granted to the institution of the Family and for the parents’ rights to ensuring for their children „such education and teaching in conformity with their own religious and philosophical convictions”, rights to be respected by the State is consecrated by the first Protocol to the European Convention on Human Rights, other international treaties and political documents, but also through the jurisprudence of the European Court on Human Rights from Strasbourg.

The challenges in front of the Family within the current secular societies in Europe generate the risk of diminishing the parental authority, the atomization of the traditional Family and a more and more clear interference of the State in the private family life following the ideological secular liberal model. Nevertheless the recent adoption on April 27, 2017 of the Resolution 2163 (2017) of the Parliamentary Assembly of the Council of Europe politically reconfirms the essential role of the Family and of the parents in relation with their children.
