Religious freedom and public safety: a legal analysis from the perspective of international and constitutional law.
The article examines the complex relationship between religious freedom and public security from a legal perspective, focusing on international law and Romanian constitutional law. The study takes as its starting point international documents, such as the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and the European Convention for the Protection of Human Rights and Fundamental Freedoms, which recognize freedom of religion as a universal fundamental right, but allow for its limitation under certain strictly defined conditions, among which is public security. This study also examines the provisions of the Romanian Constitution related to these limitations, showing how the domestic judicial order approaches the reconciliation of freedom of religion with the requirements of collective security. The analysis aims to elucidate the delicate balance between protecting freedom of belief on the one hand and the responsibility for public security through state control on the other, indicating theoretical as well as practical aspects regarding this tension.
